GENERAL TERMS AND CONDITIONS OF USE FOR THE ARDENNE PHOTO LIBRARY

Access to the photo library is reserved for people whose aim is to promote the Belgian, French and Luxembourgian Ardennes, that is to say the French Ardennes department, the province of Namur, the province of Liege, the province of Luxembourg and the Eislek region of Luxembourg. All of these territories form the ‘Destination Ardenne’

These general conditions of use are expressly subject to the provisions of the Intellectual Property Code.

The general conditions outlined below are intended to regulate the use of photographic images acquired by all the Ardenne Attractivity and AGRETA project partners:

• The European Economic Interest Group "Destination Ardenne"
• The Tourist Federation of Belgian Luxembourg (FTLB)
• The Tourist Development Agency of the Ardennes (ADT08)
• The Federation of Tourism in the Province of Namur (FTPN)
• The Tourist Federation in the Province of Liège
• The Regional Tourist Office of the Luxembourgian Ardennes

ARTICLE 1: RIGHTS OF USE

These rights of use relate to:

Loans of free documents, without the purpose of sale, to partners who are members of the Ardenne brand, for the promotion of the destination (within the limit of a maximum A4 illustration format, excluding appearance on front or back cover and/or on their website in 72 DPI).

Loans for press articles exclusively for the tourist promotion of the destination Ardenne (up to a maximum A4 illustration format, excluding front and back cover and/or on their website in 72 DPI), written by journalists.

Loans to tourism partners, travel agents, associations, coaches, schools, institutions, tourism federations, tourism development agencies, tourist offices and tourist desks in the destination

Ardenne, organisations, companies, tour operators,... of free documents, without the purpose of sale, for the promotion of the destination

Loans to communication agencies working directly with Destination Ardenne partners within the context of communication, promotion or publishing operations.

All uses for purely commercial purposes are excluded.

ARTICLE 2: PROVISION

Any use of a loaned visual must be justified as soon as it is published and within two months, by:

ARTICLE 3: MODIFICATION

Any modification of any kind whatsoever, in any form or by any technical process, is prohibited, except with the prior written consent of one of the project partners mentioned in the preamble.

ARTICLE 4: MANDATORY PHOTO CREDIT & DEADLINE FOR USE

The moral right of the authors is inalienable and it is imperative that any published visual be accompanied by the following mention: Destination Ardenne / Name of the photographer.

Each visual is subject to a rights end date indicated in the legend. Any use beyond this end date is strictly prohibited.

ARTICLE 5: PROPERTY

The photographic images made available by the Destination Ardenne are the property of the author or their beneficiaries, the borrower can only acquire the right of reproduction and/or representation.

These photographic images cannot be sold but are only and exclusively offered as a loan.

ARTICLE 6: APPLICABLE LAW, COMPETENT COURT AND CONTRACTUAL DOCUMENTS

These general conditions of use are governed by the law in force in France. Any use that does not comply with the terms and conditions of use of the Ardenne destination's image library may be subject to legal proceedings before the relevant courts.
These terms and conditions and restrictions are subject to change. The user is required to read them initially and to re-read them with each use.

ARTICLE 7: GUARANTEES

The user has access to the secured image library using a username and a password. In all circumstances, the user undertakes to keep their username and password secret and is prohibited from communicating them to third parties. The user is responsible for any use made of their username and password and any use/exploitation of the resulting photographs. In the event that the confidentiality of username and password can no longer be guaranteed, the user agrees to immediately inform the GEIE at Destination Ardenne.

The user guarantees the image library that they will use the photographic images in accordance with these general conditions and that in the event of any non-compliant or prohibited use, they act as guarantor for the Destination Ardenne against any recourse, any prosecution, any complaint or any request by any person in connection with such use of the photographic images.

The user agrees to take up the case and cause and indemnify the GEIE at Destination Ardenne in the event of any recourse, prosecution, claim or request relating to a non-compliant or prohibited use of the photographic images under this contract when they borrow any photographic image.

ARTICLE 8: RETENTION OF PERSONAL INFORMATION

When the user completes the registration form to access the photo library, all the information contained in their profile is kept in the administrator file. At any time, the user can access this profile and, if necessary, make changes by accessing ‘My Account’.
